Introduction

It is extremely important to us to ensure that you not only have a pleasant experience on NiceMingle but also that you feel comfortable and safe while doing so. We are committed to protecting your privacy through our compliance with this policy. The use of personal information collected through our services shall be limited to the purpose of providing the service for which you have engaged us.

Our servers are at this time located in Singapore and operated by Google Cloud and Amazon Web Services. This policy describes our practices in connection with information that we collect through our websites (collectively our “Websites”) through our platform (collectively our “Platform”) as well as through email messages that we send to you (collectively including the Websites and the Platform our “Services”). It also governs the collection, use, and disclosure of your information.

Data Collection

The data collection plays an important role in NiceMingle event planning. NiceMingle will use the collected data to prepare and customize the event experience as well as for our future products and Services. As data controllers, we are taking steps to ensure the personal data we hold is accurate and up to date. We have implemented measures to maintain accuracy and taken reasonable steps to erase or rectify any inaccurate personal data.

Our Platform allows us to plan an event experience and manage events. This can include collecting contact information and other demographic information from you who are participating in events.

Cloud

At this time, NiceMingle uses Cloud Services from Google Cloud and Amazon Web Services. In terms of data protection, cloud computing means the processing of personal data on behalf of NiceMingle as a cloud user through the cloud provider. Data protection regulations require that the cloud user only chooses cloud providers that provide reasonable guarantees for proper technical and organizational measures. Google Cloud and Amazon Web Services complies with data processing and security conditions and act for us as a processor of personal data under the law. Google Cloud and Amazon Web Services provides its clients with updated contract terms in accordance with the new requirements of data protection.

Information We Collect and Receive

We may collect and receive information from you in the following situations:

• When you register for an application for the event with us.
• When you choose to connect your application with an external third-party service or application such as Facebook or Google.
• When you use the features and functions available on our Services, for example, by interacting with our chat or messaging feature.
• If you contact us, for example with a query or to report a problem.
• When you interact with us offline or through an external third party.

You are under no obligation to provide the information to us. However, if you choose to withhold the information or to revoke permission for us to receive the information, we may be unable to provide certain aspects of our Services to you.

By providing us with any information relating to a third party (e.g. information of your spouse, children, parents, and/or employees) you represent to us that you have validly obtained the consent of the third party to provide us with their information for the respective purposes.

We may collect and receive the following information. Please note that not all of our Services collect all of the information listed below:

• “Personal Information” that identifies an End-User as an individual or relates to an identifiable person. For example, this includes name, organization, title, postal address, e-mail address, telephone number, fax number, social media account ID, or other identifiers by which End-Users may be contacted online or offline.
• “Other Information” that does not reveal a person’s identity or directly relate to an individual on its own or in combination with other information we have collected, such as browser and device information, operating system, device type, system and performance information, usage data, information collected through cookies, pixel tags, and other technologies, general geographic location, demographic information, and other information provided by a person such as dietary preferences, interests, activities, age, gender, education, and occupation.
• Any other information disclosed by you in any of the above-mentioned methods and/or through the use of our Services.
• Aggregate data collected through the use of our Services.
• Any communications between you and another user of our Services.

Public Forum

NiceMingle may offer publicly accessible message boards and community forums. Please keep in mind that if you directly disclose any information through such public message boards or forums, this information may be collected and used by others. We will correct or delete any information you have posted on the Platform if you so request.

Log Files

NiceMingle may collect demographic information such as your ZIP code, age, gender, preferences, interests, and favorites using log files. There may also be information about your computer hardware and software that is automatically collected by us. This information can include: your IP address, browser type, domain names, access times, and referring website addresses. This information is used by NiceMingle for the operation of the Platform, to maintain its quality, and to provide general statistics regarding the use of the Platform. For these purposes, NiceMingle may link this automatically-collected data to personal information such as name, email address, address, and phone number.

Why We Collect the Information and How We Use It

We may use the information collected and received from you for the following purposes:

• To present our Services and their contents.
• To provide information, products, or services you request from NiceMingle, for example by processing event registrations, enrolling you in events in which you choose to participate, or providing access for a meeting organized.
• To manage Platform accounts, provide client service, and process payments for purchases.
• To provide notices about NiceMingle accounts, including expiration and renewal notices.
• To notify changes to our Services, any products or services we offer or provide through our Services, our terms and conditions applicable to the Services, or this Privacy Policy.
• To communicate by e-mail, postal mail, telephone, and/or mobile devices about products or services that may be of interest and that are offered by us or other third parties, but only upon request.
• To allow you to participate in online products, access and download materials, and use other interactive features on our Services.
• To better tailor Website and Platform experience and display content according to user preferences.
• To facilitate social sharing functionality.
• For our business purposes such as data analysis, audits, fraud monitoring and prevention, developing new products, enhancing, improving or modifying our Services, and operating and expanding our business activities.
• As we believe to be necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal processes; (c) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (d) to carry out our obligations and enforce our terms and conditions applicable to the Services and other agreements, including for billing and collection purposes; (e) to protect our operations; (f) to protect our rights, privacy, safety, or property, you or others; (g) to allow us to pursue available remedies or limit the damages that we may sustain; and (h) to protect against or identify fraudulent transactions. This includes exchanging information with other companies and organizations where reasonably necessary for the purposes of fraud protection and credit risk reduction.

• To fulfill any other purpose for which you provide it or with your consent.
• To process or resolve any dispute arising from or in connection with any transactions in accordance with our Terms of Service.
• Responding to your queries and resolving complaints.

Who We Share Your Information With

We may share information about you in the following ways:

• To our contractors, service providers, and other third parties as reasonably necessary or prudent to provide, maintain, and support our Services, such as for example payment processors, data analytics providers, and data center or Web hosting providers. We may share the information with our potential partners, investors, and other parties with a view to a potential business partnership, collaboration, joint venture, or otherwise in furtherance of our business.
• We may share any information collected in accordance with this Privacy Policy with: (i) governmental and other regulatory authorities or the courts in any jurisdiction; (ii) any third-party claimants or potential third-party claimants; or (iii) your card-issuing bank, financial institution, and/or payment service provider to process or resolve disputes arising from or in connection with a transaction using our Services in accordance with our Terms of Service.
• In addition to other information described in this Privacy Policy, we may collect and share with third-party data management platforms or advertising and analytics partners precise location information. This location information may be used by itself, aggregated, or combined with mobile identifiers (such as IDFAs and Android IDs) and shared with third parties for purposes related to advertising, analytics, attribution (e.g. measuring ad performance), analytics, and market research. • We may disclose your personal information if required to do so by law or if we believe that such action is necessary to prevent fraud or crime or to protect our Services or the rights, property, or personal safety of any person.

We respect your privacy and we will not sell your personal information to any third party. We may disclose data and aggregate statistics about users of our Services and sales to prospective partners, advertisers, sponsors, and other reputable third parties in order to describe our Services, deliver targeted advertisements, or for other lawful purposes, but these data and statistics will not include information that can be used to identify you.

By using our Services, you authorize us to use your information for the purposes mentioned above. We will ensure that your information is transferred in accordance with this Privacy Policy and protected in accordance with applicable laws on personal data protection.

The security of your information is important to us. We have security measures in place to protect against the loss, misuse, and alteration of information under our control. We also follow generally accepted industry standards to protect the information transmitted to us over the Internet, both during transmission and once we receive it. However, no method of transmission over the Internet or method of electronic storage is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your information, we cannot guarantee its absolute security.

It is important that you protect against unauthorized access to your Account and information by choosing your password carefully and keeping your password and Account secure (e.g. by signing out after using our Services).

Third Party Services

This Privacy Policy does not address, and we are not responsible for, the privacy information or other practices of any third parties, including any third party operating any site or service to which the Services or this Policy link. The inclusion of a link on the Services or within this Policy does not imply endorsement of the linked site or service by us or by our affiliates. Please note that we are not responsible for the collection, usage, and disclosure policies and practices (including the data security practices) of other organizations, such as Facebook, Apple, Google, Microsoft, BlackBerry, or any other company, social media platform providers, operating system providers, wireless service providers, or device manufacturers, including any Personal Information you disclose to other organizations through or in connection with the Platform even though we have data protection agreements with our contractors if necessary.

Tracking Technologies

We use tracking technologies on our Services. This enables us to understand how you use our Services, which in turn helps us to provide and improve our Services. However, the tracking technologies do not access, receive, or collect information that can be used to identify you. We have listed below some examples of the tracking technologies used on our Services:

• Cookies. A cookie is a small data file sent from a website to your browser that is stored on your device. Cookies are used for a number of purposes including to display the most appropriate content based on your interests and activity on our Services, estimate and report our Service's total audience size and traffic, and conduct research to improve our Services. We may also partner with selected third-party vendors such as Google Analytics to allow tracking technologies and remarketing services on our Platforms through the use of first-party cookies and third-party cookies for such purposes. You can configure your device's settings to reflect your preference to accept or reject cookies. If you reject all cookies, you will not be able to take full advantage of our Services.
• Pixels. We may from time to time use certain Facebook Business Tools such as the Facebook Pixel. This tool allows us to keep track of what users do after they see or click on a Facebook advertisement and enables us to monitor the effectiveness of Facebook ads for purposes of statistics and market research. We will be able to better understand and deliver ads and make them more relevant to you. The collected data remains anonymous and we cannot see the personal data of any individual user.

However, the collected data is saved and processed by Facebook. Facebook may be able to connect the data with your Facebook account and use the data for their own advertising purposes and in accordance with Facebook’s Data Use Policy. Facebook has ultimate control of the information gathered through the Facebook Business Tools and communications.

Data collected in this way is anonymous to us, which means we cannot see the personal data of individual users. However, this data is saved and processed by Facebook. Facebook can connect this data with your Facebook account and use it for its own advertising purposes in accordance with Facebook’s Data Policy which can be found at https://www.facebook.com/about/privacy/. You can allow Facebook and its partners to place ads on and outside of Facebook. A cookie can also be saved on your device for these purposes.

Flash cookies. We use Flash cookies (a.k.a local shared objects or LSOs) to store some of your viewing preferences on our Services. These are used to collect and store information but differ from browser cookies in the amount, type, and manner in which data is stored.

We seek to use reasonable organizational, technical, and administrative measures to protect Personal Information within our organization. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. You are responsible for reviewing the changes which we make to this Privacy Policy. Your continued use of our Services constitutes your acceptance of the updated Privacy Policy.

Please kindly note that where this Privacy Policy has been translated to any other non-English language, in the event of any inconsistencies in the meaning of any provision of the English language text of this Privacy Policy, the English language text shall prevail.
